1. About BuildPro Leads

BuildPro Leads is a subscription-based lead generation service that provides general contractors and remodelers ("Contractors") with verified homeowner leads via SMS and email delivery. We are operated by Commerce Neo, a company incorporated in Canada.

2. Eligibility

You must be at least 18 years of age and operate a legitimate contracting or remodeling business to use our services. By using BuildPro Leads you represent and warrant that you meet these requirements.

3. Free Trial

We offer a free trial of 5 verified homeowner leads delivered over 2 days. The free trial is available once per business. After the trial period expires:

• Your reserved zip code territory will be released after 48 hours if no paid plan is selected
• We reserve the right to offer your territory to another contractor
• No credit card is required for the free trial

4. Subscription Plans & Payments

We offer three subscription tiers billed monthly:

• Starter: $697 USD/month — 20 verified leads
• Pro: $1,500 USD/month — 50 exclusive verified leads
• Elite: $2,500 USD/month — 100 leads with AI follow-up

All payments are processed securely through Stripe. Subscriptions auto-renew monthly unless cancelled. Prices are in USD. Canadian customers may be subject to applicable taxes.

5. Cancellation & Refunds

You may cancel your subscription at any time with no cancellation fee. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial months of service.

If you experience a technical failure on our end resulting in zero leads delivered in a given month, you are entitled to a credit for that month upon written request to [email protected].

6. Lead Quality & Guarantee

We verify all leads before delivery. Verification includes confirming a valid phone number, project intent, and budget range. However:

• We do not guarantee that any lead will result in a closed job
• We do not guarantee specific close rates or revenue outcomes
• Lead quality can vary by market, season, and project type
• We replace verified leads that have invalid phone numbers if reported within 48 hours of delivery

7. Exclusive Territory

Pro and Elite plan subscribers receive exclusive leads within their selected zip code(s). This means no other contractor on our network in the same zip code receives the same leads. Exclusivity applies only to our network — homeowners may contact multiple contractors independently.

8. SMS Communications

By subscribing to any paid plan you consent to receive SMS messages from BuildPro Leads including lead delivery notifications, account updates, and promotional offers. Message frequency depends on your plan (up to 5 messages per day on active plans). Standard message and data rates may apply.

To opt out of SMS: Reply STOP to any message. You may continue to receive leads via email after opting out of SMS.

9. Prohibited Uses

You also agree not to:

• Use leads to send unsolicited spam or harass homeowners
• Misrepresent your business credentials to homeowners
• Attempt to reverse-engineer or scrape our platform
• Use our service for any unlawful purpose
• Create multiple accounts to obtain multiple free trials

10. Intellectual Property

All content, branding, and technology on the BuildPro Leads platform is owned by Commerce Neo. You may not copy, reproduce, or distribute any portion of our platform without written permission.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Commerce Neo shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including lost revenue, lost profits, or lost business opportunities.

Our total liability to you for any claim arising from these terms shall not exceed the amount you paid us in the 30 days preceding the claim.

12. Disclaimer of Warranties

BuildPro Leads is provided "as is" without warranties of any kind. We do not warrant that our service will be uninterrupted, error-free, or that leads will meet your specific business requirements.

13. Indemnification

You agree to indemnify and hold harmless Commerce Neo, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these terms.

14. Governing Law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Montreal, Quebec, Canada.

15. Changes to These Terms

We may update these Terms of Service at any time. We will notify you of material changes by email or by posting a notice on our website. Continued use of our services after changes constitutes acceptance.
